| Resumo: | O presente trabalho trata-se de uma investigação científica sobre o fenômeno do linchamento nas sociedades contemporâneas. Antes de tudo, coube averiguar sobre sua origem histórica derivada da chamada vingança privada. Posteriormente, buscou-se explicar o conceito de justiça delineado por Aristóteles para, enfim, expor de que forma a vingança privada e seus efeitos foram sendo superados com a transferência do poder de punir para o Estado com a criação do aparelho judicial, passando-se então a prevalecer a vingança pública ou justiça pública. Todavia, demonstrou-se que diante de uma crise de legitimidade da justiça pública e do aumento considerável da criminalidade, a população toma para si o encargo de exercer a justiça com as próprias mãos como forma de supostamente restabelecer a paz e o controle social. |
| Abstract: | The present work deals with a scientific investigation on the phenomenon of lynching in contemporary societies. First of all, it was necessary to ascertain about its historical origin derived from the call private revenge. Subsequently, it was tried to explain the concept of justice delineated by Aristóteles to, finally, to expose in what form the private revenge and its effects were being surpassed with the transference of the power to punish to the State with the creation of the judicial apparatus, being passed prevail then the public revenge or public justice. However, it has been shown that in the face of a crisis of legitimacy in public justice and a considerable increase in crime, the population takes on the responsibility of exercising justice with their own hands as a way of supposedly restoring peace and social control. |
