Title: A reforma trabalhista e a precarização do emprego com o enfraquecimento dos sindicatos

Resumo: No dia 13 de julho de 2017 foi publicada a lei 13.467. O texto, denominado Reforma Trabalhista, passa a ter vigência a partir de 11/11/2017 alterando a CLT (Decreto Lei 5.452 de 1º de maio de 1943). As alterações são muitas, porém o presente trabalho busca dar foco às alterações relacionadas aos artigos que versam sobre a negociação direta, ou seja, disposições que permite o livre acordo entre as partes, empregador e empregado. Além disso aborda também a relação dessa permissão com a alteração prevista no novo texto que traz ao empregado a faculdade da contribuição sindical, anteriormente obrigatória. O intuito do presente estudo é demonstrar que a negociação direta associada à desobrigação de contribuir com os sindicatos das respectivas categorias pode causar um aumento da hipossuficiência do trabalhador frente aos contratantes. Têm-se, historicamente, os sindicatos como os grandes representantes e a força de luta da classe operária. Os mesmos operam em defesa dos interesses da classe trabalhadora, sobretudo, financiados pelo próprio trabalhador através da até então obrigatória contribuição sindical de cada uma das categorias existentes.
Abstract: On July 13, 2017, Law 13,467 was published. The text, called Labor Reform, becomes effective as of 11/11/2017 by amending the CLT (Decree Law 5,452 of May 1, 1943). The changes are many, but the present work seeks to focus on the changes related to the articles that deal with direct negotiation, that is, provisions that allow free agreement between the parties, employer and employee. In addition, it also discusses the relationship of this permission with the amendment provided in the new text that brings to the employee the faculty of union contribution, previously mandatory. The purpose of the present study is to demonstrate that the direct negotiation associated with the disengagement of contributing to the unions of the respective categories can cause an increase of the employee's hyposufficiency towards the contractors. The unions have historically been the great representatives and the fighting force of the working class. They operate in the interests of the working class, above all, financed by the worker himself through the hitherto obligatory union contribution of each of the existing categories.
