| Resumo: | Esta pesquisa visa a compreender a relação entre o direito autoral e o efeito de aprisionamento no mercado de programas de computador. Os setores de sistema operacional em computadores pessoais e telefones são investigados para fornecer um diagnóstico sobre como os elementos supracitados interagem. A metodologia empregada consiste em uma análise empírica e qualitativa de conteúdo por meio das regras de inferência, segundo Epstein e King, e da perspectiva teórica de viver plenamente a lei, em Zenon Bankowski. A principal conclusão é de que o efeito de aprisionamento não ocorre sobre todo o setor de software. Contudo, onde ele é observado, é possível notar que as regras do direito autoral operam uma degeneração da aspiração moral e tende a promover uma posição de monopólio das firmas proprietárias. |
| Abstract: | This research aims to understand the relationship between copyright and the lock-in effect in the software market. The sectors of operating systems in desktops and mobiles are investigated to provide insights about how these two elements above interact. The methodological framework consists in an empirical and qualitative analysis of content based on the Epstein and King’s rules of inference and the Zenon Bankowski’s theoretical perspective of living lawfully. The main conclusion is that the lock-in effect does not occur in all operating system sectors. Nevertheless, when that happens, it is possible to observe that the copyright rules have a degenerated role of their aspiration as well as tend to promote a monopoly position for proprietary firms. |
