| Resumo: | Diante da atual mudança na Lei de Lavagem de Capitais, um ator se mostra de suma importância na prevenção e combate ao delito previsto nessa lei, por isso o presente trabalho trata do instituto do compliance na Lei de Lavagem de Capitais e tem como objetivo identificar a posição do compliance officer como garantidor perante a referida lei, em decorrência dos deveres de cuidado, proteção, bem como de vigilância estabelecidos por ela. Além disso, utiliza-se o princípio da culpabilidade na vertente que veda a responsabilização penal objetiva para traçar a responsabilidade penal do compliance officer. |
| Abstract: | Giving the recent changes in the Capital Laundering Law, an active factor takes place to prevent and fight the offense provided in this law, therefore the present work aims to explain the institute of compliance on the Capital Laundering Law. It also identifies the complianceofficer position as the guarantor on the Capital Laundering Law, in view of the duty of care, protection, as well as the vigilance ruled on the said law. Also, the principle of the guilt strand forbids the objective penal accountability to draw the penal accountability of the compliance officer. |
