Em busca de uma solução para a realidade carcerária a partir das CPIs do sistema penitenciário: a humanização da pena em enfoque

Abstract

The question of penitentiary reality in Brazil, unfortunately, a long time ago has aroused our attention in a negative way. Waves of violence and disregard for the penitentiary population have already become trivial matters for local media. The absence of adequate infrastructure and the problem of overcrowding, added to the way in which the functions of the penalty in Brazil are understood, creates a penitentiary underworld, where there is no concern with the prisoner and with a dignified sentence execution, capable of re-socializing the citizen and therefore reducing our high rate of recidivism. The present work, through the analysis of the 4 (four) Parliamentary Committees of Inquiry (CPIs) already performed, observing what was actually implemented and its effectiveness, has identified a number of improvements brought by them, as in the case of special courts and creation of the National Penitentiary Fund. However, such measures only soften the effects of this reality, it was concluded that humanization at the time of execution of the sentence is a possible alternative to change this reality.
