| Resumo: | O presente estudo tem como escopo investigar os institutos do dolo eventual e da culpa consciente, destacando suas diferenças e semelhanças com o intuito de verificar, na prática, como se dá a responsabilização do binômio dolo/culpa, tomando como cenário o caso ocorrido durante as manifestações de cunho político no Rio de Janeiro, quando o cinegrafista Santiago Ilídio Andrade teve sua vida subtraída após ser atingido por um rojão enquanto fazia a cobertura jornalística. Serão analisadas as teorias que compreendem as modalidades de dolo e culpa e conferir a sua aplicação no direito brasileiro e as consequências processuais que a sua incorreta classificação pode implicar. |
| Abstract: | The purpose of this study is to investigate the institutes of enventual fraud and conscious guilt, highlighting their differences and similarities in order to verify, in practice, how to give the malice / guilty binomial accountability, taking as a scenario the case that occurred during the political manifestations in Rio de Janeiro, when the cameraman Santiago Ilídio Andrade had his life subtracted after being hit by explosive artifact while making the journalistic coverage. We will analyze the theories that comprise the modes of deceit and guilt and verify its application in Brazilian law and the procedural consequences that its incorrect classification may imply. |
