| Resumo: | Pretende-se com o presente trabalho analisar as questões relacionadas à criminalização do aborto, verificando os argumentos contrários e favoráveis à retirada da conduta do Código Penal, bem como às perspectivas e tendências atuais acerca do tema. Assunto complexo por envolver questões que ultrapassam a seara jurídica, o aborto tem ganhado relevância nos debates legislativos, jurisprudenciais e principalmente na área da saúde pública. Através de breve percurso que perpassa uma síntese histórica da evolução legislativa acerca do tema até o entendimento atual sobre o assunto, propõe-se a reavaliação da tipificação do aborto como conduta criminosa, haja vista a ineficácia da atual política criminal adotada, ainda verificando-se a necessidade de o Estado tratar a questão como problema relacionado à saúde da mulher. |
| Abstract: | The present work intends to analyze the questions related to the criminalization of abortion, verifying the arguments opposing and favorable to the withdrawal of the conduct on the Penal Code, as well as the perspectives and current trends on the theme. A complex subject, because involves questions that surpass the juridical area, abortion has been gaining relevance in legislative, jurisprudential and public health debates. Through a short course that involves a historical synthesis of the legislative evolution about the theme up until the current understanding on the subject, this work proposes the reevaluation of abortion’s typification as a criminal conduct, in sight of the inefficacy of the currently adopted criminal policy, and yet verifies the need for the State to treat the question as a problem related to women’s health. |
