| Resumo: | O presente trabalho procura desenvolver a temática da Justiça Restaurativa como contraponto ao Sistema Retributivo e como alternativa eficaz na resolução de conflitos. Para tanto, analisa-se o embate entre os dois discursos, ressaltando suas características e discutindo suas diferenças e as dificuldades de implementação de meios alternativos. Através de uma abordagem teórico-bibliográfica, busca-se demonstrar que a rigidez do sistema de justiça penal pode e deve adaptar-se às novas formas de solução de conflitos existentes, dentre as quais se inclui a Justiça Restaurativa que, além de propiciar maior eficiência e celeridade à resolução de conflitos, é importante passo na garantia da justiça e do fortalecimento do Estado Democrático de Direito. |
| Abstract: | The present work seeks to develop the theme of Restorative Justice as a counterpoint to the Remuneration System and as an effective alternative in solving conflicts. In order to do so, we analyze the clash between the two discourses, emphasizing their characteristics and discussing their differences and the difficulties of implementing alternative means. Through a theoretical-bibliographical approach, one seeks to demonstrate that the rigidity of the criminal justice system can and should adapt to new ways of solving existing conflicts, among which includes Restorative Justice, which, in addition to providing greater efficiency and speed in there solution of conflicts, it is an important step in ensuring justice and strengthening the democratic rule of law. |
