| Resumo: | O objetivo deste artigo é defender o direito fundamental de acesso à justiça, a ampla defesa e ao contraditório ao policial militar, sendo enfatizada a obrigatoriedade de o Estado custear a defesa técnica do profissional, em especial, nas hipóteses de excludente de ilicitude. Defender-se-á que o policial militar, independentemente de sua renda, tem o direito de ter acesso a defesa técnica gratuita por meio de defensores públicos ou advogados dativos. Verifica-se que o Estado não oferece amparo ao policial militar enquanto agente de segurança pública, mesmo considerando-se que o policial atua em nome do próprio Estado. A metodologia adotada é bibliográfica e crítico dialética. |
| Abstract: | The purpose of this article is to defend the fundamental rigth of access to justice, the ample defense and the contradictory to the military police officer, being emphasized obligatoriness of the State to defray the technical defense of the professional, especially, in the hypotheses of exclusion of unlawfulness. Will be defended that the military police officer, irrespective of his income, has the right to access free technical defense by public defenders or dative advocates. It is verified that the State does not offer support to the military police officer as agente of public security, even considering that the policeman acts in the name of the own State. The methodology adopted is a bibliographical and critical dialectic. |
