| Resumo: | Em um contexto de redemocratização e diante crise estrutural apresentada pelo Poder Judiciário, em razão da enorme quantidade de demandas, se mostrando incapaz de promover uma prestação jurisdicional célere, a Constituição Federal de 1988 autorizou a criação dos Juizados Especiais Cíveis e Criminais. Assim, instituído pela Lei nº 9.099/95, o Juizado Especial Criminal introduziu algumas inovações direcionadas à melhoria da atividade processual como a denominada “justiça negocial”. O interesse para este trabalho de pesquisa é indagar se após decorridos mais de 20 anos da promulgação da Lei nº 9.099/95 seus anseios iniciais foram hoje alcançados. Busca-se, através da aplicação do método cartográfico diante da experiência prática na 23ª Promotoria de Justiça do Estado de Minas Gerais na cidade de Juiz de Fora, realizar uma análise crítica e reflexiva sobre a real efetividade da Lei 9.099/95 na prática atual. |
| Abstract: | In a context of re-democratization and in the face of a structural crisis presented by the Judiciary, due to the huge amount of lawsuits, proving incapable of promoting a rapid judicial provision, the Federal Constitution of 1988 authorized the creation of civilian specialties and criminal courts. Thus, established by Law 9.099/95, the Special Criminal Court introduced some innovations aimed at improving the procedural activity as the so-called "negotiating justice". The interest in this research is to investigate whether, after more than 20 years after the enactment of Law 9.099/95, its initial yearnings were reached. Through the application of the cartographic method to the practical experience of the 23rd Public Prosecutor of the State of Minas Gerais in the city of Juiz de Fora, a critical and reflexive analysis of the real effectiveness of Law 9.099/95 in current practice. |
