Tribunal permanente dos povos – uma análise do “Capítulo México” e seu legado para o sistema internacional dos direitos humanos

Abstract

This present study intends to analyze the work performed by the Permanent People’s Tribunal, which, despite its few mentions in academic papers, has almost 40 years of history and a massive popular participation in its sessions. The session chosen for the analysis was the Mexico Chapter, which handles the impacts of free trade market in Mexican people’s life. The grounds of the verdict are developed in this work from Professor Juan Zubizarreta’s perspective. The conclusion is that there is a process of meeting private interests to the detriment of communities’ rights, communities which suffer frequent violations and don’t receive any aid from the State or from the international community. The Tribunal recommendations’ to try to make the situation a bit better are described. After the case study, the aim is to defend that, due to the great significance of the verdict content, it should be invested with binding force and be considered an autonomous source of International Law, using various authors to achieve the expected conclusions.
