| Resumo: | O fio condutor dessa dissertação é a problemática que envolve o artista mirim e o direito ao trabalho, tendo em vista a previsão constitucional que proíbe o exercício do trabalho por menores de 16 anos, salvo na condição de aprendiz, a partir dos quatorze. Contudo, poderia ser considerado como outro qualquer o trabalho artístico? Não deve ser concedida ao jovem a oportunidade de participar em um determinado espetáculo artístico? O embate que será apresentado é entre a proteção à criança e ao adolescente versus o direito desses à atuação em trabalhos artísticos. É notória a existência e até mesmo a importância desse tipo de trabalho hodiernamente, não sendo razoável pensar em sua proibição, conforme várias razões que serão apresentadas. Será analisada a possibilidade dessa espécie de trabalho, desde que respeitadas uma série de condições, mediante as quais os pequenos artistas estarão resguardados de todos os seus direitos, enquanto seres em formação, e, ainda, não serão suprimidos em seus anseios artísticos. |
| Abstract: | The main idea of this thesis is the problem that involves the young artist and the right to work, in view of the Constitutional provision that prohibits the performance of work by children under 16, except as apprentices, by the time they are fourteen years old. However, could it be considered like any other artwork? Should it not be given to the young people the opportunity to participate in a particular artistic performance? This framework is going to present the protection of children and adolescents versus the right to performance in these artworks. It is noticed the existence and even the importance of such work in our times, and it is not reasonable to think of its ban, considerating several reasons that will be presented. It will be analyzed the possibility of this kind of work, in compliance with a range of conditions under which the young artists will be protected according to all their rights as human beings and also will not be shed in their artistic aspirations. |
