| Resumo: | Diante do entendimento adotado pela sociedade de que a dignidade da pessoa humana não é ontológica e do descaso Estatal perante a situação do preso brasileiro e de sua dignidade, o presente trabalho busca demonstrar que a existência da dignidade humana do preso é inquestionável e que cabe ao Estado garanti-la como condição indispensável para sua própria manutenção. Assim, o presente estudo é pautado pela noção de dignidade humana enquanto valor ontológico da pessoa, tendo em vista a adoção, pela Constituição Federal de 1988, deste valor como princípio basilar, incorporando a idéia de que todos possuem dignidade independentemente de seus atos. |
| Abstract: | In face of the understanding adopted by the society that the dignity of the human person isn’t ontological and of the negligence of the State in front of the situation of the Brazilian arrested and his dignity, this monograph seeks to show that the existence of the human dignity of the arrested is out of question and that it is a duty of the state do guarantee it as a condition of its own maintenance. So, the present study is guided by the notion of the human dignity as a human ontological value, which the adoption by the Federal Constitution of 1988 of this concept as a basic principle as its final objective, incorporating the idea that everyone has dignity, and doesn’t matter their acts, that fact don’t change. |
