| Resumo: | O presente trabalho investiga, a real adequação do instituto do Tribunal do Júri ao ordenamento pátrio, sobretudo quando contraposto aos valores atinentes ao Estado Democrático de Direito e ao Garantismo Penal. Para tanto, parte de uma abordagem histórica, analisando os fundamentos sob o qual foi moldada a instituição no mundo e no Brasil, concluindo-se que, atualmente, existem outros mecanismos capazes de garantir ao acusado a real preponderância de seus direitos, protegendo-o do Estado. Por derradeiro são colocadas em pauta alternativas que visam a adequação do instituto ao moderno ordenamento brasileiro, alternativas estas que visam minimizar as incongruências da instituição e o Estado Democrático de Direito. |
| Abstract: | This work investigates the adequacy of the Institute of true grand jury to national order, especially when measured against the values pertaining to the democratic state of law and garantismo criminal. To this end, part of a historical approach, examining the reasons upon which the institution has been shaped in the world and in Brazil, concluding that, currently, there are other mechanisms to ensure the accused a real preponderance of their rights, protecting the the state. For ultimate alternatives are placed on the agenda aimed at the adequacy of institute of the modern order brazilian, these options intended to minimize inconsistencies of the institution and democratic state of law. |
