| Resumo: | Este trabalho busca uma reflexão baseada na Literatura para que se desenvolva uma análise dos temas do Direito, no esforço de melhor compreendê-lo. A novela "Michaël Kohlhaas", do escritor alemão Heinrich von Kleist, será o pilar da presente pesquisa e fornecerá tanto informações quanto subsídios que auxiliarão na análise sobre a Justiça e a Vingança e como tais conceitos são encarados subjetivamente. Tratar-se-á de uma pesquisa teórico-qualitativaindutiva relacionando a obra com autores diversos como Ricoeur, Kant, Ésquilo, Ihering, Nozick, Munoz, entre outros, na tentativa de demonstrar que a Justiça parcial, ou a violência em busca dela, não são o propósito do Direito. |
| Abstract: | This work seeks a reflection based on the Literature to develop an analysis about themes of Law, in an effort to better understand it. "Michaël Kohlhaas", the German writer Heinrich von Kleist's novel, will be the pillar of this research and it will provide as much information as subsidies to assist in the analysis of Justice and Vengeance and how these concepts are viewed subjectively. It will be a theoretical, qualitative and inductive research, linking the novel with authors as diverse as Ricoeur, Kant, Aeschylus, Ihering, Nozick, Munoz, among others, in an attempt to demonstrate that partial Justice, or violence in pursuit of it, are not the purpose of the Law. |
