| Resumo: | O presente trabalho alvitra-se a demonstrar, que diante da crise do Monismo, o Pluralismo Jurídico torna-se o novo referencial jurídico na busca de uma sociedade multicultural mais justa, na qual a diferença é um valor. Como forma de se analisar a proposta da nova ordem normativa, a Teoria do Reconhecimento de Axel Honneth será utilizada para indicar uma forma de aplicação do Pluralismo. Por fim, o pano de fundo da investigação será a sociedade brasileira que se insere em uma imensa diversidade cultural. Por este motivo, de forma meramente exemplificativa, será apresentada a política indigenista no Brasil, em uma análise crítica, para a real necessidade de mudança para uma ordem normativa pluralista. |
| Abstract: | The present work seeks to demonstrate that, in front of the crisis of Monism, the Legal Pluralism becomes the new benchmark in the legal pursuit of a multicultural society more just, in which the difference is a value. As a way to examine the proposal of the new normative order, the Axel Honneth's Theory of Recognition will be used to indicate a way to apply the pluralism. Finally, the background of the research will be the brazilian society that is inserted in an immense cultural diversity. For this reason, just in the illustrative way, will be presented to indigenous politics in Brazil, in a critical analysis, for the real need for change to a normative order pluralistic. |
