| Resumo: | A discussão trazida pelo presente trabalho insere-se nos campos da literatura, da criminologia e do direito penal, uma vez que este procura analisar a perpetuação da condenação penal, tendo em vista a questão da estigmatização do sentenciado. Considerando as desigualdades presentes na realidade brasileira do século atual, marcada pela seletividade e estigmatização dos que são submetidos ao jus puniendi do Estado, o que se propõe é uma análise comparativa entre a sociedade francesa do século XIX, retratada por Victor Hugo em sua principal obra, Os Miseráveis, e a sociedade brasileira atual, de modo a evidenciar que o problema do sistema penal falho advém, em primeiro lugar, de uma realidade social marcada pela desigualdade. |
| Abstract: | The discussion brought by this academic work includes literature, criminology and criminal law, given that it intends to analyze the perpetuation of criminal conviction, considering the issue of stigmatization of the condemned. Considering social inequalities present in today's Brazilian society, marked by elitism and stigmatization of those who are under the Estate's jus puniendi, the purpose of this work is a comparative analysis between the French society in the 19th century, portrayed by Victor Hugo in his masterpiece, Les Misérables, and today's Brazilian society, in order to point out that the problem of this failed law system comes, in the first place, from a social reality tainted by social inequality. |
