| Resumo: | O presente trabalho tem por objeto demonstrar a atuação opressiva da mídia na divulgação dos crimes dolosos contra a vida, a qual promove julgamentos prévios, indo além da sua função de informar, influenciando sobremaneira o Conselho de Sentença do Tribunal do Júri. Mostra-se o imperioso papel que a imprensa desenvolve em um país no qual a ditadura não reina mais e procura-se destacar que ao exceder esse papel a imprensa viola os princípios norteadores do processo penal constitucional, impedindo o cidadão de ser julgado à luz do devido processo legal. Além disso, analisa-se a história e os princípios do Tribunal do Júri, demonstrando-se que o discurso midiático, por vezes, acaba por afastar a instituição dos fins para os quais fora criado. Em um Estado Democrático de Direito, não raras vezes, deverá prevalecer o julgamento justo sobre a liberdade de expressão, eis que esse não é um direito absoluto e não pode servir de salvaguarda da ditadura da imprensa. |
| Abstract: | The aim of this work is to demonstrate the oppressive role of the media in publicizing felonious crime against human life, in which promotes bias trials, thus trespassing its informative role, deeply influencing the jury in the court of law. It shows the overwhelming role the press exerts in a country which the military dictatorship is no longer in power. This work tries to point out that when the media exceeds its purpose, it violates guiding principles of the legal process, denying the citizen a fair trial in legitimate legal proceedings. Furthermore, it examines the history and the principles of the Court of Law, demonstrating that the media rhetoric actually distances the institution from the purposes for which was created. In a democratic state based on the rule of the law, many a times, a fair trial must prevail over the freedom of expression, since this is not an absolute right. |
