| Resumo: | Trata-se de estudo que busca investigar a condição do embrião como pessoa, tendo como norte a corrente jurídica civil-constitucional. São analisados conceitos antropológicos de pessoa, as posições jurídicas na doutrina sobre o início da vida, o histórico das constituições, a constitucionalização do direito civil, a Constituição da República Federativa do Brasil, e o antigo e o atual Código Civil Brasil eiro. Além disso, busca-se uma compreensão sobre o nascituro como ser tutelado pela Dignidade da Pessoa Humana e toda a proteção dela decorrente. |
| Abstract: | It is a study that seeks to investigate the condition of the embryo as a person, with the northern civil legal-constitutional power. Anthropological concepts of person, the legal position on the doctrine of the early life history of constitutions, constitutionalization of civil law, the Constitution of the Federative Republic of Brazil, and former and current Brazilian Civil Code are analyzed. In addition, we seek an understanding of the unborn as being mentored by Human Dignity and all the protection resulting therefrom. |
