| Resumo: | O presente trabalho visa a realizar uma análise pormenorizada da Súmula 277 do TST. O estudo inicia-se por alguns institutos do Direito Coletivo do Trabalho, perpassando pelos mecanismos de solução dos conflitos trabalhistas coletivos e atentando para a negociação coletiva, os acordos e convenções coletivas decorrentes da negociação e, especificamente, o prazo de vigência desses diplomas coletivos negociados. Ressalta o histórico da referida súmula, o atual entendimento adotado pelo TST e suas implicações, apontando as divergências doutrinárias a respeito do tema. O marco teórico consiste na evolução doutrinária e nas modificações legislativas sobre a ultra-atividade dos diplomas negociais coletivos, bem como na importância da negociação coletiva para o Direito Coletivo do Trabalho, sendo o tema abordado sob o método dialético. |
| Abstract: | The present study aims to conduct a detailed analysis of Precedent 277 of the TST. The study begins by some institutes of Collective Labour Law, passing by the mechanisms of resolution of collective labor disputes and noting the collective bargaining agreements and collective agreements under negotiation and, specifically, the validity of these diplomas collectivebargaining. Highlights the history of that summary, the current understanding adopted by TST and their implications, pointing out the doctrinal differences regarding the subject. The theoretical framework consists of the doctrinal evolution and the legislative changes on the activity of ultra-diplomas collective bargaining, as well as the importance of collective bargaining to the Collective Labour Law, the subject being addressed under the dialectical method. |
