| Resumo: | O presente trabalho visa demonstrar a indispensável relevância jurídica da fé, numa acepção mais ampla e totalmente desprendida de qualquer religião específica, no direito à ressocialização dos egressos do Sistema Prisional. Para tanto foi desenhado o histórico do sistema prisional e como a religião interferiu tanto em escala mundial quanto na nacional. Após, destacou-se a precariedade do modelo atual de cumprimento de pena, sinalizando, portanto, para uma necessidade de buscar métodos alternativos e complementares, a fim de verdadeiramente cumprir as funções da pena estabelecidas pela LEP. Por fim, foi feita uma análise acerca do tratamento dispensado à assistência religiosa pela legislação hodierna, principalmente no tocante às problemáticas experimentadas pela Lei 9982/00. E, finalmente, enfatizou-se a sua relevância na jurisprudência interna e nos debates internacionais, finalizando com o destaque a dois métodos assistenciais religiosos brasileiros, a Pastoral Carcerária e o Método APAC. |
| Abstract: | This paper demonstrates the necessary legal relevance of faith in a broader sense totally detached from any specific religion about the right to rehabilitation of ex-convicts. For that was designed the history of the prison system and how religion interfered both worldwide and in the national. After highlighted the precariousness of the current model of serving sentence, signaling to a need to seek alternative and complementary methods in order to truly fulfill the functions of the penalty established by LEP. Finally an analysis was made about the treatment of religious assistance by contemporary legislation, especially to the problems experienced by Law 9982/00. And lastly emphasized the relevance in internal law and in international discussions, concluding with the highlight two Brazilian religious assistance methods, the Pastoral Carcerária and the APAC method. |
