| Resumo: | A presente monografia trata do tema da responsabilidade civil da mídia no inquérito policial. O estudo da responsabilidade civil dos meios de comunicação por atos no inquérito policial é de natureza multidisciplinar, pressupondo necessária interação de vários ramos do direito, quais sejam, processo penal, civil e constitucional, além de outras áreas do saber, como a sociologia, aspecto que indica a relevância do problema que se enfrenta. Primeiramente será feito um estudo sobre o princípio da presunção da inocência, um dos pilares do sistema acusatório consagrado pela Constituição. Em seguida, adentrar-se-á no inquérito policial, instrumento do processo penal que possui o sigilo como uma característica. Será feita uma análise sobre as influências da atuação midiática no tratamento do investigado pela sociedade e pelo Judiciário. Por fim, será feita uma abordagem sobre a natureza da responsabilidade da mídia no inquérito policial, sendo defendida a responsabilidade civil objetiva e indireta das empresas jornalísticas e subjetiva dos profissionais da mídia. |
| Abstract: | This monograph deals with the issue of liability of the media in the police investigation. The study of liability of the acts by the media in the police investigation is multidisciplinary, assuming required interaction of various branches of law, such as criminal procedure, civil and constitutional, and other disciplines, such as sociology, aspect that indicates the relevance of the problem being faced. First will be a study on the principle of presumption of innocence, one of the pillars of the adversarial system established by the Constitution. Then it will be entering the police investigation, criminal procedure instrument that has the secrecy as a feature. An analysis of the influences of media activity in treating investigated by society and the judiciary will be made. Finally, a discussion of the media's responsibility of nature in the police investigation, and defended the lens and indirect liability of journalistic and subjective business of media professionals will be made. |
