| Resumo: | O presente trabalho pretende discutir a influência que as drogas exercem sobre a criminalidade e violência, configurando-se um grande problema atual e que tantos males traz à sociedade, abordando o tratamento dado à questão e de que forma a situação poderia ser modificada. Tal análise foi construída a partir do estudo de importantes bibliografias na área de Direito Penal, artigos acadêmicos, estatísticas e, por se tratar de um tema com grande repercussão na mídia, notícias de jornal. Inicialmente, é abordada a relação dos entorpecentes com a violência, destacando-se seus principais aspectos. Passando-se às formas como a sociedade encara a questão das drogas, são tecidos comentários sobre a Lei 11.343/2006, bem como a política externa relativa ao tema. Apresenta a falência do sistema carcerário vigente e a função ético-social do Direito Penal, apontando as medidas alternativas como solução, principalmente a ressocialização e a prevenção, concluindo que estas são imprescindíveis para reduzir a violência. |
| Abstract: | This study discusses the influence that drugs have on crime and violence, setting up a large current problem is that so many evils brings to society by addressing the treatment of the issue and how the situation could be changed. This analysis was built from the study of important bibliographies in the field of criminal law, scholarly articles, statistics, and it is a theme with great media coverage, newspaper articles. Initially, the list of drugs to violence is discussed, highlighting its main aspects. Turning to the ways in which society views the drug issue are comments made about the Law 11.343 / 2006, as well as foreign policy on the subject. It shows the failure of the current prison system and the ethical and social function of criminal law, pointing out alternative measures as a solution, mainly the rehabilitation and prevention, concluding that these are essential to reduce violence. |
