| Resumo: | A Lei 9.099/95, que disciplina os Juizados Especiais Criminais veio para melhorar o sistema processual penal, buscando formas de corrigir os problemas enfrentados nas máquinas judiciárias. Há muito tempo tem-se preocupado com um sistema penal mais eficiente e justo, que apresentasse respostas mais rápidas e ao mesmo tempo mais operativas, com penas diferentes à privativa de liberdade, trazendo inovações muito importantes para a Justiça Criminal, tais como a transação penal e a suspensão condicional do processo. A Justiça Militar da União prega pela inaplicabilidade desta Lei, com fundamento na especialidade da Justiça Castrense e nos princípios norteadores das Forças Armadas, a hierarquia e disciplina, mas de outro lado encontram-se outros princípios que também são essências em um Estado democrático de direito, tais como, o princípio da isonomia e o princípio da proporcionalidade. Assim, o objetivo geral se encontra na investigação da possibilidade de aplicação das medidas despenalizadoras criadas a partir da Lei dos Juizados Especiais no âmbito da Justiça Militar da União e, caso seja utilizada, como se operaria dentro do Direito Penal Militar. |
| Abstract: | Law 9.099 / 95, which regulates the Special Criminal Courts came to improve the criminal justice system, seeking ways to fix the problems faced in the judicial machinery. It has long been concerned with a more efficient and fair criminal justice system , to produce faster and even more operating time answers , with different penalties to imprisonment for bringing very important innovations for the criminal justice system , such as plea bargaining and the conditional suspension of the proceedings. The Military Justice preaches the inapplicability of this Law, based on the specialty of Military Justice and guiding principles of the Armed Forces , hierarchy and discipline, but on the other hand are other principles that are also essences in a democratic rule of law such as the principle of equality and the principle of proportionality . Thus, the overall goal is to investigate the possibility of applying the measures despenalizadoras created from the Special Courts Act as part of the Military Justice and, if used , as would operate within the Military Penal Law. |
