Análise da (in)compatibilidade entre o modelo de financiamento da universidade pública brasileira atual e a teoria da igualdade de recursos de Ronald Dworkin

Abstract

The present article analyses the current model of public brazilian Universities’ funding – through taxes borne by the society as a whole – in light of Ronald Dworkin’s theory of justice, which is based on a reconciliation between equality of resources and individual liberty. From a bibliographical review one investigates whether this model is compatible with the hypotetical insurance market used by the jurist to design fair institutions. One is brought to the conclusion that it is not, because it is equivalent to an irrational decision from the intrapersonal standpoint and because it violates the envy test. Afterwards, one explores the privatization model and concludes that the previous test isn’t fulfilled. Finally, one presents the co-participative funding model, in which the financially able students share part of their education costs, and proves that this model is compatible with the dworkian ideal of justice. Still, one tries to outline this model, as well as present its limitations and the possible solutions for these.
