| Resumo: | O Brasil vem enfrentando um grande problema penitenciário, hoje tem-se prendido mais, mesmo não possuindo condições dignas para manutenção do preso. A falta de estrutura gera consequências para as quais o poder público não consegue solucionar. Visando contribuir para uma possível solução do problema, o presente estudo aborda uma efetiva implementação dos meios alternativos de pena prevista no Código Penal vigente, com viés de retirar do cárcere, presos primários, com base no furto simples – crime sem violência ou grave ameaça à vítima – que segundo as análises realizadas para elaboração desse estudo é um dos crimes que possui o maior número de encarcerados no país. |
| Abstract: | The Brazil is facing a major prison problem today has arrested, more even not having proper conditions for maintenance of the prisoner. The lack of structure creates consequences for which the Government cannot solve. To contribute to a possible solution of the problem, the present study discusses an effective implementation of alternative means of penalty provided for in the current Penal Code, with bias to remove from the jail, inmates, based on simple theft – crime without violence or serious threat to the victim – which according to the analyses carried out for the preparation of this study is one of the crimes that has the largest number of prisoners in the country. |
