| Resumo: | O presente estudo tem como objetivo principal analisar o modelo norte-americano de justiça consensual, com foco no instituto da plea bargaining e o papel que este instrumento exerce nos Estados Unidos, bem como, a problemática acerca da importação e influência do mesmo no Brasil. Busca-se, para tanto, examinar as principais características do sistema processual dos Estados Unidos e o papel da justiça consensual em sua seara criminal, analisar os problemas mais relevantes quanto à importação de mecanismos de um ordenamento jurídico para outro, apreciar a influência do modelo estadunidense no Brasil, além de analisar a aplicação e manutenção do instituto da plea bargaining. O presente estudo se justifica diante da tendência, no Brasil, da importação, adaptação e adoção de institutos no âmbito do processo penal no que concerne à justiça consensual, que tem como principal fonte o modelo norte-americano e seu instituto da plea bargaining. Foram reunidos no decorrer do presente trabalho as exposições de diversos autores que discorrem sobre o tema para, ao final, verificar se a plea bargaining é um instrumento que deve ter sua vigência mantida e se é meio viável e recomendável de ser adotado frente a realidade brasileira. |
| Abstract: | This study aims to analyze the North American model of consensual justice, focusing on the Plea Bargaining Institute and the role this instrument plays in the United States, as well as the problems about importing and influence of the same in Brazil. The aim is to, therefore, examine the main features of the US court system and the role of consensual justice in a criminal realm, analyze the most relevant problems about importing mechanisms of a legal system to another, appreciate the influence of the American model in Brazil, in addition to reviewing the implementation and maintenance of the Plea Bargaining institute. This study is justified by the trend in Brazil of importation, adaptation and adoption of institutes in criminal proceedings with regard to consensual justice, whose main source the US model and its Institute of Plea Bargaining. Were gathered in the course of this work exhibits of many who talk about the subject to at the end, check if the Plea Bargaining is an instrument that must have its validity maintained and if it is a viable medium and a recommended one to be adopted across the Brazilian reality. |
