| Title: | Identificação criminal mediante extração do DNA (ácido desoxirribonucleico): um confronto necessário entre Direito Penal do Inimigo e Estado de Direito |

| Resumo: | O presente trabalho tem como objetivo analisar a Lei nº 12.654/12 sob a perspectiva do Direito Penal do Inimigo de modo a verificar a sua (in)compatibilidade com o Estado de Direito. O referido diploma legal promoveu alterações na Lei de Identificação Criminal (Lei nº 12.037/09), bem como na Lei de Execução Penal (Lei nº 7.210/84), ao prever uma nova forma de identificação criminal, qual seja, a realizada por meio da extração de DNA (ácido desoxirribonucleico), para posterior comparação com vestígios deixados em eventual cena de crime. Com a reunião de todos os elementos teóricos necessários para a análise do tema, chegou-se à conclusão que a lei em comento concretiza as ideias do denominado Direito Penal do Inimigo e, por conseguinte, suas disposições normativas são incompatíveis com o Estado Democrático de Direito instituído pela Constituição Federal de 1988. |
| Abstract: | This study aims to analyze Law nº 12.654/12 from the perspective of criminal law of the enemy in order to check their (in)compatibility with the rule of law. The said law made changes in the Criminal Identification Act (Law nº 12.037/09) and the Penal Execution Law (Law nº 7.210/84), by providing a new form of criminal identification, namely, performed by DNA extraction (deoxyribonucleic acid), for comparison with traces left in any crime scene. With the meeting of all the theoretical elements necessary for the subject of analysis, we came to the conclusion that the law under discussion embodies the ideas of the so-called Criminal Enemy of law and therefore their regulatory provisions are incompatible with the democratic rule of law established by the 1988 Federal Constitution. |
