| Resumo: | O presente trabalho tem por escopo examinar o princípio da unicidade sindical, corolário do Direito Coletivo pátrio, consagrado na Consolidação das Leis do Trabalho (CLT) e na Constituição Federal, verificando de que forma contribui para o enfraquecimento das relações sindicais. Por meio de uma digressão histórica, demonstrar-se-á a herança corporativista importada da legislação fascista italiana, sua origem eminentemente antidemocrática e os nefastos reflexos que se perpetuam até hoje. Pretende-se analisar a atual crise do sindicalismo em razão deste princípio, propondo um modelo viável para substituí-lo, embasado por experiências semelhantes em outros países, notadamente a Itália. |
| Abstract: | This work aims to examine the principle of trade union unity, corollary of Brazilian Collective Labor rights, enshrined in the Labor Laws and the Federal Constitution, checking how it contributes to the weakness of union relations. By means of a historical digression, we intend to demonstrate the corporatist heritage imported from the Italian fascist legislation, its highly antidemocratic origin and the adverse consequences perpetuated nowadays. We intend to analyze the current union crisis from the perspective of this principle, proposing a viable model to replace it, based on similar experiences in other countries, notably Italy. |
