| Resumo: | Este trabalho, fruto de uma pesquisa qualitativa calcada em fontes indiretas, enfrenta a problemática afeta à questão das biografias não autorizadas no ordenamento jurídico pátrio. Embora o Supremo Tribunal Federal já tenha se manifestado sobre o tema recentemente (2014) através da ADIN 4815, urge uma análise reflexiva acerca do tema, mormente através das perspectivas do Pós-Positivismo, Neoconstitucionalismo e Direito Civil-Constitucional. Além disso, busca-se releitura do instituto das biografias através da teoria dos fatos. Não se pode descurar que o tema relativo às biografias não autorizadas envolve uma série de conflitos relativos a direitos fundamentais e direitos da personalidade, de forma que se tornou necessário o enfrentamento de questões relativas às fronteiras entre o Direito Público e o Direito Privado. Por último, torna-se objetivo do presente trabalho a proposição de alguns standards, baseados no conceito moderno de privacidade de modo a direcionar o tratamento do tema afeto às biografias no ordenamento nacional. |
| Abstract: | This work, the result of a qualitative research grounded on indirect sources, faces the problem affects the issue of unauthorized biographies on brazilian law. Although the Supreme Court has already spoken out on the subject recently (2014) by ADIN 4815, urges a reflective analysis of the topic, mainly through the perspectives of post-positivism, Neoconstitutionalism and Civil-Constitutional Law. In addition, it seeks to re-reading of the Institute of biographies through the theory of the facts. One can not overlook the issue on unauthorized biographies involves a series of disputes concerning fundamental rights and rights of personality, so that it became necessary to address issues concerning the boundaries between public law and private law. Finally, objective of the present work it is the proposition of some standards, based on the modern concept of privacy in order to direct the affection theme treatment to biographies in national law. |
