| Resumo: | Este artigo tem a finalidade de analisar, sob a ótica política-criminal, a decisão proferida pelo Supremo Tribunal Federal, em 26 de junho de 2024, que descriminalizou o uso, além da posse e do porte da maconha para consumo pessoal. A decisão estabelece regras objetivas para diferenciar o traficante do usuário, ao mesmo tempo em que propõe novas diretrizes para a atuação policial e o encaminhamento dos agentes a sanções de caráter não penal. Para tanto, foram utilizadas pesquisas bibliográfica e jurisprudencial, de modo a compreender o impacto dessa decisão no sistema judiciário e na sociedade. Além disso, o estudo examina as potenciais repercussões dessa mudança legislativa. |
| Abstract: | This article aims to analyze, from a political-criminal perspective, the decision handed down by the Federal Supreme Court, on June 26, 2024, which decriminalized the use, in addition to possession and possession, of marijuana for personal consumption. The decision establishes objective rules to differentiate the trafficker from the user, at the same time that it proposes new guidelines for police action and the referral of agents to non-criminal sanctions. To this end, bibliographical and jurisprudential research was used in order to understand the impact of this decision on the judicial system and society. Furthermore, the study examines the potential repercussions of this legislative change. |
