Abstract

The present work addresses the complexity of evidentiary challenges in cases of sexual violence against children within the family context. Beginning with an analysis of the alarming scenario of intrafamilial violence, the vulnerability of children in this environment is emphasized. The research objectives were guided by the understanding of obtaining material evidence in situations of child sexual violence, evaluating the relevance of the victim's testimony, and strategies to minimize revictimization. The theoretical framework, consisting of national and international studies, laws, and treaties, supported the discussion. The combined approach of bibliographic and qualitative research allowed for a detailed analysis, exploring legal aspects to nuances of real cases. The study contributes to a deeper understanding of evidentiary challenges, providing insights to overcome obstacles. The research highlighted the urgency of addressing layers involving sexual violence against children within the family. Protecting children's rights and seeking justice require collaboration across legal, health, and societal domains. Reflections emphasize the need for multidisciplinary approaches, considering not only legal aspects but also psychological and social dimensions. Current challenges include the lack of legislative regulation, the need for professional training, and integration among institutions. The study underscores the importance of creating a secure environment for children, involving society in preventing and addressing this serious violation of rights.
