| Resumo: | A Lei n. 13.476/2017 foi aprovada tendo como um de seus objetivos a redução do número de ajuizamento de reclamações trabalhistas, permitindo o uso da arbitragem nos contratos individuais de trabalho (art. 507-A do Decreto-lei n. 5.452/1943). O Direito do Trabalho possui características majoritariamente sociais, ao passo que a Arbitragem sempre foi vista no ordenamento brasileiro como um meio de resolução de conflitos que versem sobre relações comerciais, especialmente as que envolvem grandes quantias e de maior complexidade. Assim, a partir de uma extensa revisão bibliográfica sobre o tema, este estudo busca analisar se os critérios estabelecidos pela reforma trabalhista foram os mais adequados para a aplicação do instituto, a partir dos princípios da Arbitragem e do Direito do Trabalho, bem como os impactos do art. 507-A da CLT nas Câmaras Arbitrais. |
| Abstract: | The Law n. 13.476/2017 was approved having as one of its objectives the reduction of the number of labor claims filing, allowing the use of arbitration in individual labor contracts (art. 507-A of Decree-law n. 5.452/1943). The Labor Law has mostly social characteristics, while Arbitration has always been seen in Brazilian law as a means of conflict resolution that deal with commercial relations, especially those involving large amounts and greater complexity. Thus, from an extensive literature review on the subject, this study seeks to analyze whether the criteria established by the labor reform were the most appropriate for the application of the arbitration, based on principles of this institute and Labor Law, as well as the impacts of art. 507-A of Consolidation of Labor Laws in the Arbitration Chambers. |
