| Resumo: | O presente artigo trata da problemática envolvendo a pensão alimentícia fornecida pelo alimentante quando o filho é usuário de drogas e recebe diretamente os alimentos. Para explicitar o tema, utilizar-se-á a metodologia de pesquisa bibliográfica, casos colhidos da jurisprudência bem como uma entrevista realizada com um pai que por anos indiretamente sustentou o vício de seu filho através do pagamento da verba alimentícia. Inicialmente, será realizado uma análise sobre o direito-dever dos alimentos aos vulneráveis, discorrendo sobre esse instituto, os tipos de alimentos, suas características e finalidades. Em seguida, apresentar-se-á três casos envolvendo filhos adictos e a prestação alimentícia para ao final discorrer sobre possíveis alternativas para garantir a assistência ao mesmo tempo em que se evita o consumo de drogas. |
| Abstract: | This article deals with the problem involving the alimony provided by the child supporter when the child is a drug user and receives the alimony directly. To explain the theme, the methodology of bibliographical research will be used, cases collected from jurisprudence as well as an interview with a father who for years indirectly supported his son's addiction through the payment of the alimony. Initially, an analysis will be carried out on the right-duty of food to the vulnerable, discussing this institute, the types of food, its characteristics and purposes. Then, three cases involving addicted children and alimony will be presented, in order to finally discuss possible alternatives to guarantee assistance while avoiding drug consumption. |
