Abstract

During the Covid-19 pandemic, the protection of the right to health was in evidence. And that is why the performance of the Administrative Council for the Defense of Competition (CADE) and the National Supplementary Health Agency (ANS), in this context, draw attention. This as the body responsible for regulating health plan operators (OPS) and the other as indispensable to the competitive dynamics verified in the sector. The objective of this work is to understand the sector's relevant market and the phenomenon of vertical integration. In addition to understanding the conduct of the ANS in facing the health crisis. To this end, the work was developed in three sections: The first is intended to present an overview of the relationship between the health crisis, health plans and the performance of the ANS. The second is intended to show precisely the relevant market in the supplementary health sector, highlighting the characteristics that permeate the sector. The third is intended to present the phenomenon of verticalization, as well as its effects on competitive dynamics. Here we see how vertical integration can be an unfavorable choice for the supplementary health market and how the ANS has performed its role as a regulatory agency in the face of sectoral concentration.
