| Resumo: | O presente trabalho é uma investigação científica acerca dos elementos necessários para reparação dos danos causados por ilícitos penais. Antes de tudo, coube explicar as concepções do termo “justiça” delineado por Aristóteles, com quais espécies de ações e qual espécie de meio-termo elas se relacionam. Em seguida, buscou-se demonstrar a relação entre equidade e justiça, sobretudo quando de sua aplicação, para, enfim, introduzir os critérios e institutos da Lei nº 9.099/95, especificamente dos Juizados Especiais Criminais, os quais são aplicados às infrações penais de menor potencial ofensivo, buscando, sempre que possível, o restabelecimento do in statu quo ante, com a consequente reparação dos danos experimentados pela vítima. |
| Abstract: | The present work deals with a scientific investigation about the elements necessary to repair the damage caused by criminal offenses. First of all, it was necessary to explain the conceptions of the term "justice" outlined by Aristotle, with which species of actions and what kind of middle ground they are related. Next, we sought to demonstrate the relationship between equity and justice, especially when it comes to its application, introduce the criteria and institutes of Law nº 9.099/95, specifically the Special Criminal Courts, which are applied to criminal offenses of lesser offensive potential, seeking, whenever possible, the reestablishment of the in statu quo ante, with the consequent reparation of the damages experienced by the victim. |
