| Resumo: | O presente trabalho tem por objeto o estudo da influência que a mídia exerce sobre as decisões dos jurados no julgamento dos crimes de competência do Tribunal do Júri, abordando o impacto negativo que é gerado ao princípio constitucional da presunção de inocência, segundo o qual ninguém é considerado culpado até o trânsito em julgado da sentença penal condenatória. Tendo em vista o grande poderio que os veículos de comunicação possuem sobre a opinião pública, objetiva-se, aqui, demonstrar como uma cobertura massiva, sensacionalista e parcial de um evento criminoso pode comprometer os direitos e garantias individuais que, em teoria, deveriam ser assegurados ao acusado. |
| Abstract: | This work aims to study the influence the media exerts on the jurors' decisions in the judgment of crimes within the competence of the jury court, addressing the negative impact that is generated on the constitutional principle of the presumption of innocence, according to which no one is guilty until the final and unappealable criminal sentence. Bearing in mind the great power the communication vehicles have over public opinion, the objective here is to demonstrate how massive, sensationalist and partial coverage of a criminal event can compromise the individual rights and guarantees that, in theory, should be guaranteed to the public accused. |
