| Resumo: | O presente trabalho tem como objetivo analisar criticamente, a partir de um levantamento bibliográfico e jurisprudencial, o atual estágio de reconhecimento das famílias poliafetivas e famílias paralelas pelo Direito de Família. Parte-se de uma breve explanação histórica-evolutiva para alcançar o que se entende como família atualmente e verificar, dentre os modelos elencados pela doutrina, aqueles que permanecem invisibilizados pelo ordenamento pátrio, notadamente famílias poliafetivas e paralelas. Assim, enfrenta-se a monogamia, principal argumento contrário à tutela jurídica dessas entidades, propondo-se uma leitura integrativa do direito posto frente aos princípios constitucionais da dignidade humana, liberdade e igualdade, evidenciando-se, assim, a necessidade de se adequar o mundo jurídico à realidade social das famílias, garantindo a tutela jurídica a essas estruturas familiares. |
| Abstract: | This work aims to critically analyze, from bibliographic and jurisprudential standpoints, the current stage of recognition of poly affective families and parallel families on Family Law. It starts with a brief historical-evolutionary explanation to reach what is understood as a family today and to verify, from the models listed by doctrine, those that remain invisible to law, notably polyaffective and parallel families. Thus, monogamy is faced, as the main argument against the legal protection of these entities, proposing an integrative reading of the law in regard to the constitutional principles of human dignity, freedom and equality, making the need to adapt evident to the legal world the social reality of families, guaranteeing legal protection to these family structures. |
