| Resumo: | Os esforços de análise empreendidos neste trabalho têm por objetivo refletir sobre a seletividade penal e sua relação com a discriminação racial, a partir das ações punitivas do Estado voltadas para este fim. Para deslindar essas reflexões, busca-se, a partir do processo de formação da sociedade brasileira, por meio da revisão de literatura, estabelecer a relação entre o racismo institucional e estrutural na seletividade do sistema judiciário, principalmente no que tange ao Direito Penal. Destaca-se o papel do Poder Judiciário dentro de um sistema de exploração no qual a questão racial se torna estrutura para sua própria manutenção e como forma de controle social na conjuntura Neoliberal. |
| Abstract: | The analysis efforts undertaken in this work aim to reflect on criminal selectivity and its relationship with racial discrimination, based on the punitive actions of the State aimed at this end. In order to unravel these reflections, it is sought from the process of formation of Brazilian society, through literature review, to establish the relationship between institutional and structural racism, such as the selectivity of the judiciary, especially with regard to Criminal Law. The role of the Judiciary is highlighted within a system of exploitation in which the racial issue becomes a structure for its own maintenance and as a form of social control. |
