A precarização das condições de trabalho dos caminhoneiros no Brasil: uma análise da precarização e da garantia de direitos da categoria profissional

Abstract

This paper aims to analyze the reasons that lead to precarious working conditions for truck drivers in Brazil. For that, the methodology used was bibliographic research, legislation and newspapers, under the descriptive and analytical methods. In this sense, we sought to understand what are the roots of this precariousness and the possible contradiction between the national stoppages carried out by truck drivers, which have great political and social relevance, and the real working conditions of the professional category itself, based on the theory of subjectivity coined by Ricardo Antunes. In this way, it was intended to make an analysis about the configuration of labor relations relevant to truck drivers, both in the legal scope and in the practice experienced by them, as well as the legislative forecasts on the subject, in order to demonstrate how they affect the labor situation. of these workers. In addition, it was analyzed how different agents contribute to the poor working conditions experienced by this category, including the truck driver himself. Finally, the feasibility of applying the institute of parasubordination to truck drivers was examined as a way to remove the precariousness of work and, it was concluded that further studies on these workers are needed, so that measures can be adopted that really promote the protection and guarantee of rights, without depriving them of the autonomy that is so dear to this category.
