Direito responsivo e Administração Pública: A Universidade Federal de Juiz de Fora como um estudo de caso da aplicação do decreto 9.094/17

Abstract

Bureaucracy is the heart of administrative institutions. Its existence refers to the State organization itself and is the key to the management of public resources and the realization of rights. However, since its first organizations, bureaucracy has acquired contradictory characteristics to its own purposes: efficiency and organization. Based on the work of Philippe Nonet and Philip Selznick, Law and Society: Transition Toward Responsive Law, the present work has the scope to analyze bureaucracy under an evolutionary prism, where the low resolution, marked by massification and self-defense, will lead to a gradual transition to a legal organization focused on the solution of it’s tasks rather than it’s own procedures. To this end, a case study was carried out within the present institution, seeking to reveal its characteristic features according to the theoretical framework used and, then, how its transition to responsive law has taken place, having as a parameter the Decree 9.094/17 .
