| Resumo: | O presente artigo aborda os aspectos relevantes do procedimento de usucapião extrajudicial introduzido no ordenamento pátrio através do Novo Código de Processo Civil. O trabalho foi dividido em quatro partes, a primeira faz uma abordagem do instituto da usucapião, sua origem e características, e também são analisadas as principais modalidades. Na segunda parte, tratou-se de fazer um levantamento histórico da legislação que instituiu o procedimento extrajudicial no Brasil. Na terceira abordou-se o fenômeno da desjudicialização, como tentativa do legislador de afastar do judiciário objetos que não sejam, de fato, discussão dos órgãos de justiça, mas apenas dos interessados. A quarta parte ficou encarregada do procedimento dentro das serventias extrajudiciais, enfatizando as tendências de desjudicialização, e o procedimento de usucapião extrajudicial como alternativa para garantir a celeridade e eficácia na realidade brasileira. |
| Abstract: | This article discusses the relevant aspects of the extrajudicial usucapion procedure in the national order through the New Code of Civil Procedure. The work was divided into four parts, the first deals with the institute of usucapion, its origin and characteristics, and the main modalities are also analyzed. In the second part, it is a matter of making a historical survey of the legislation that instituted the extrajudicial procedure in Brazil. In the third, the phenomenon of dejudicialization was approached, as an attempt by the legislator to remove from the judiciary objects that are not, in fact, discussions by the justice bodies, but only by those interested. The fourth part was in charge of the procedure within the extrajudicial services, emphasizing the trends of dejudicialization, and the extrajudicial usucapion procedure as an alternative to guarantee the speed and effectiveness in the Brazilian reality. |
