| Resumo: | O estudo ora apresentado tem como objetivo principal identificar os impactos que afetaram a contagem de prazo da Lei 11.101/05 em virtude do advento do CPC 2015, para tanto buscar-se-á identificar quanto à forma de contagem dos prazos previstos na Lei de Recuperações e Falência após o novo CPC; identificar a natureza dos prazos, se material ou processual; identificar a jurisprudência do STJ sobre a forma de contagem antes da lei 14.112/20 e identificar o cenário pós lei 14.112/20. A metodologia utilizada será a pesquisa bibliográfica com utilização de livros, artigos científicos, teses, dissertações, jurisprudências e doutrinas que tratam sobre o tema. Serão apresentados projetos de lei em tramitação que visam realizar alterações definitivas na lei de 11.101/05 bem como a nível emergencial em virtude da pandemia que assola o Brasil e todo o mundo. |
| Abstract: | The main objective of the present study is to identify the impacts that affected the deadline count of Law 11.101/05 due to the advent of the new CPC, in order to seekwill identify how to count the deadlines provided for in the Recovery and Bankruptcy Act after the new CPC; identify the nature of the deadlines, whether material or procedural; identify the case law of the STJ on the form of counting before the law 14.112/20 and identify the post-law scenario 14.112/20. The methodology used will be bibliographic research using books, scientific articles, theses, dissertations, jurisprudences and doctrines that deal with the subject. Bills will be presented in progress that aim to make definitive amendments to the law of 11.101/05 as well as at the emergency level due to the pandemic that plagues Brazil and the world. |
