| Resumo: | O presente artigo tem como objetivo analisar como as excludentes de ilicitude são tratadas no Brasil. A partir de revisão teórica, o estudo verifica que, em especial as excludentes especiais, acabam por ter uma análise relegada a segundo plano. Constata-se que, como nunca se deu grande importância à parte especial do código penal, a análise das causas que excluem o crime acabou ficando muito confusa, não havendo como se definir com muita precisão sobre qual a natureza jurídica de cada justificante. Essa análise acaba necessitando de malabares intelectuais para adequar cada excludente especial na natureza jurídica mais compatível às excludentes gerais; além de ser necessário analisar léxicos gramaticais e princípios gerais de direito penal para se chegar a uma resposta. |
| Abstract: | This article aims to analyze how the exclusion of illegality is treated in Brazil. Based on a theoretical review, the study verifies that, especially the special exclusions, end up having an analysis relegated to the background. It is found that, as the special part of the penal code has never been given great importance, the analysis of the causes that exclude crime ended up being very confusing, and there is no way to define precisely the legal nature of each justification. This analysis ends up requiring intellectual juggling to adapt each special exclusion to the legal nature that is most compatible with the general exclusions; besides being necessary to analyze grammatical lexicons and general principles of criminal law to arrive at an answer. |
