| Resumo: | O presente artigo tem como objetivo, primeiramente, a compreensão do quanto a implementação do juiz das garantias no ordenamento jurídico é capaz, ou não, de aproximar o sistema processual penal brasileiro daquilo que é definido como um sistema processual acusatório (e garantista), tendo em vista que a própria Lei 13.964/2019 coloca, em seu art. 3º-A, que “O processo penal terá estrutura acusatória”. Num segundo momento, a pesquisa busca respostas sobre o que diz respeito à inconstitucionalidade da implementação do juiz das garantias pela Lei “Anticrime”, partindo de uma análise dos argumentos constantes nas ADIs 6.298, 6.299 e 6.300 e da liminar proferida pelo Ministro Luiz Fux. |
| Abstract: | This article aims, firstly, to understand to what extent the implementation of the judge of guarantees in the legal system is able, or not, to bring the Brazilian criminal procedural system closer to what is defined as an accusatory (and guaranteeing) procedural system, having considering that Law 13,964/2019 itself places, in its art. 3-A, that “The criminal process will have an accusatory structure”. In a second moment, the research seeks answers about the unconstitutionality of the implementation of the judge of guarantees by the “Anticrime” Law, starting from an analysis of the arguments contained in ADIs 6.298, 6.299 and 6.300 and the injunction issued by Justice Luiz Fux. |
