Nos limites da neutralidade jurídica: trajetórias e experiências de mulheres profissionais do direito

Abstract

The present dissertation aims to reflect about the legal field relational logic and dynamics as from gender as category of analysis. Comprehending the centrality of the concepts of neutrality and objectivity in the substantiation and legitimation of the legal field and its relationship with the society, and that those notions are based on the binary fission of masculine/feminine, being that the law identifies itself – inexplicitly – with the “masculine” side of such fission, gender necessarily establishes a tension relation in the legal field. The professional women in such field, whose gendered existence is indelible, experience those tensions in their daily life, having to search means to develop their career accordingly to the neutrality speech, while their existence remains in the marked gender. In this regard, were realized semi-structured interviews with women professionals of public careers – judges, prosecutors, and public defenders – assigned to work at up-country counties in Minas Gerais, and with other by them suggested. Based on theories concerning memory and biographies, the research looked to analysis the trajectories in attention to the contexts, the relational nets and the presence of gender in the narratives. Although it is impossible to develop a broad conclusion through such an specific field of research, I could find the expected presence of gender inequalities in the legal field, towards which the interlocutors try to reaffirm their professionalism and competence through resources such as the manipulation of corporal hexis elements and the planning of their careers and families, presenting, frequently, the conscience that for women it is necessary more effort to attain professional achievements than it is for men.
