| Resumo: | O presente trabalho tem o objetivo de esclarecer se o juízo de identificação entre os casos, tido como a existência de semelhanças entre os fatos, é suficiente para sustentar a aplicação de precedentes. Nesse sentido, foi realizado uma abordagem de revisão bibliográfica das ideias construídas pelas tradições jurídicas da civil law e da common law, assim como as respectivas influências no ordenamento jurídico brasileiro. Em seguida, foram apresentados os fundamentos legais da exigência da fundamentação das decisões, que são encontrados tanto na Constituição Federal, quanto no Código de Processo Civil. Por fim, através de um estudo de caso jurisprudencial e interdisciplinar, buscou-se exemplificar a aplicação e os desdobramentos das “decisões modelo” no Poder Judiciário. Concluiu-se, ao final, que a aplicação dos precedentes é necessária para a uniformização da jurisprudência e a conservação da segurança jurídica. No entanto, a referida aplicação deve ser guiada pelas peculiaridades do caso concreto, objetivando que as decisões, em que pese uniformizadas, tenham fundamentos individualizados. |
| Abstract: | This work aims to clarify if the identification judgment between the cases, considered as the existence of similarities between the facts, is sufficient to support the application of precedents. In this sense, a bibliographic review approach was made to the ideas constructed by the legal traditions of civil law and common law, as well as the respective influences on the Brazilian legal system. Then, the legal foundations of the requirement for the reasoning of decisions were presented, which are found both in the Federal Constitution and in the Civil Procedure Code. Finally, through a jurisprudential and interdisciplinary case study, an attempt was made to exemplify the application and consequences of “model decisions” in Judiciary. It was concluded, in the end, that the application of precedents is necessary for uniformity of jurisprudence and the maintenance of legal certainty. However, this application must be guided by the peculiarities of the specific case, aiming that the decisions, despite being uniform, have individualized bases. |
