| Resumo: | O trabalho visa discutir aspectos relacionados à captação da comunicação ambiental e analisar possível solução jurídica ao problema da falta de regulamentação desse procedimento no que tange às garantias fundamentais processuais dos investigados. A metodologia se baseará em pesquisa teórico-dogmática, com pesquisa bibliográfica ampla, além de análises da jurisprudência e de informativos do STF, artigos publicados em periódicos, acórdãos, manuais jurídicos e publicações de sites jurídicos. |
| Abstract: | The paper aims to discuss aspects related to the capture of environmental communication and to analyze a possible legal solution to the problem of lack of regulation of this procedure regarding the fundamental procedural guarantees of the investigated. The methodology will be based on theoretical-dogmatic research, with broad bibliographic research, as well as analyzes of the jurisprudence and information of the Supreme Court, articles published in journals, judgments, legal manuals and publications of legal websites. |
