| Resumo: | O inquérito policial sempre foi definido pela doutrina como um procedimento administrativo, de natureza inquisitorial, presidido pelas polícias judiciárias, que tem como finalidade fornecer indícios suficientes de autoria e materialidade capazes de justificar a propositura de ações penais por parte de seu titular. Em consequência, a incidência do direito constitucional ao contraditório é quase inexistente, a participação dos defensores técnicos é limitada e as imputações ocorridas nesta fase da persecução penal, mesmo calcadas em indícios angariados sem nenhuma chancela constitucional, ensejam danos, em sua grande maioria, irremediáveis aos planos de vida dos investigados. Por tais motivos, o objetivo do presente trabalho é apresentar possibilidades aptas a aperfeiçoar a condução dos inquéritos policiais, indicando sugestões de novos deveres às autoridades policiais como forma de fomentar a incidência do contraditório participativo neste procedimento. |
| Abstract: | The police inquiry is an administrative procedure of an inquisitorial nature, presided over by the judicial police that aims to provide sufficient evidence of authorship and materiality to justify the prosecution. As a result, the incidence of the constitutional right to the adversary is almost nonexistent, the participation of the technical defenders is limited and the imputations that occurred in this phase of the criminal prosecution, even based on evidence raised without the constitutional stamp, cause, for the most part, irreparable damages. to the life plans of the investigated. For these reasons, the objective of the present paper is to present possibilities to improve the conduct of police inquiries, suggesting suggestions of new duties to the police authorities as a way of promoting the incidence of participatory contradiction in this procedure. |
