| Resumo: | O presente artigo visa à análise da composição do estupro através das perspectivas sociológica e jurídica a fim de compreender as nuances que circundam, preservam e transmitem esse crime hediondo. Adota-se como referencial teórico a teoria da dominação masculina do sociólogo Pierre Bourdieu, segundo a qual essa dominação se constitui e se dissipa por meio da violência simbólica, o que configura, portanto, a confirmação da dominação masculina como uma forma de poder simbólico. Utiliza-se para tal investigação, mediante pesquisa bibliográfica, análises complementares de pesquisa acerca da construção da psicologia social e da evolução cronológica dos dispositivos legais, como forma de demonstrar o quanto está enraizada na sociedade contemporânea a concepção da dominação masculina. Sob esses aspectos, se afere que a perpetuação do emaranhado de símbolos silenciosos que abarcam a sociedade brasileira contemporânea pode ser dirimida a partir de questionamentos sobre os papéis tradicionalmente desempenhados pelos gêneros feminino e masculino. |
| Abstract: | This article aims to analyze the composition of rape through sociological and legal perspectives in order to understand the nuances that surround, preserve and transmit this heinous crime. The theory of male domination by the sociologist Pierre Bourdieu is adopted as a theoretical framework, according to which this domination is constituted and dissipated through symbolic violence, which therefore configures the confirmation of male domination as a form of symbolic power. For this investigation, through bibliographic research, complementary research analyzes about the construction of social psychology and the chronological evolution of legal devices are used, as a way of demonstrating how much the concept of male domination is rooted in contemporary society. Under these aspects, it is verified that the perpetuation of the tangle of silent symbols that encompass contemporary Brazilian society can be resolved by questioning the roles traditionally played by the female and male genders. |
